What is the Individualized Assessment Tool?

Configured within the Adverse Action process, Sterling's Individualized Assessment tool is designed to address the Equal Employment Opportunity Commission's (EEOC) guidance as well as state and local laws on consideration of criminal records and helps you minimize the risk of claims of employment discrimination during the hiring process.

Why is This Useful?

The Equal Employment Opportunity Commission (EEOC) recommends employers provide candidates the opportunity to explain past criminal convictions uncovered during the background screening process by allowing them to provide details related to an offense and potential mitigating factors they would like the employer to consider.

Keeping up to date with rapidly changing Individualized Assessment regulations can be challenging and time-consuming, especially if you do this in-house. Our Individualized Assessment tool helps you stay in compliance and enables you to evaluate past criminal convictions in a fair, consistent way.

How to Use the Individualized Assessment Tool

Approved users can access this tool within the Order Manager:

  1. When you're in the Initiate Pre-Adverse Action in Order Manager and select a reason related to the candidate's criminal conviction/record/history, a new section will display under the potential disqualification called Individualized Assessment that you can send to the candidate.

  2. Completing the Individualized Assessment task is optional for the candidate and will remain accessible until the final Adverse Action letter is sent. 
  3. When the candidate completes the Individualized Assessment process, you will have the opportunity to review the candidate's response before making a final decision.
